1.Domino’s Pizza

Hacking group Rex Mundi held Domino’s Pizza to ransom over 600,000 Belgian and French customer records. In exchange for the personal data, which included names, addresses, emails, phone numbers and even favorite pizza toppings, Mundi demanded $40,000 from the fast-food chain.
If the ransom wasn’t met, the hackers threatened to publish the information online. The group then taunted Domino’s by saying: “Earlier this week, we hacked our way into the servers of Domino’s Pizza France and Belgium, who happen to share the same vulnerable database. Boy, did we find some juicy stuff in there.”
Domino’s refused to comply with the ransom and reassured customers that financial and banking information was not stolen. The hacking group had its Twitter account suspended and the data was never released, although it’s not clear if Domino’s ever complied with the ransom demands.

2. P.F. Chang’s

The chain restaurant suffered a huge data breach last month that compromised customer payment information. Chang’s didn’t specifically mention how many customers had been affected, but thousands of newly stolen credit and debit cards went up for sale online on June 9th.
Several banks had gotten in touch with Brian Krebs, a security journalist, to say that “they acquired from this new batch, multiple cards that were previously issued to customers, and found that all had been used at P.F. Chang’s locations between the beginning of March 2014 and May 19, 2014.”
Criminals managed to hack P.F Chang’s point of sale machines and record credit and debit card data, which then found its way on to the black market. Stolen records were being sold for between $18 and $140, with the price depending on how fresh the stolen data is. Chang’s responded by going low-tech and using age old manual credit card imprinting machines to take payment in its stores, which it then upgraded to new “encryption-enabled terminals”.
Chang’s is still working with the US Secret Service to discover the identity of the hackers.

3. Montana Health Department

The State of Montana’s health department revealed that a data breach may have affected more than 1 million people. The hack actually happened in July last year, but it wasn’t discovered until May this year, with the identity of the intruders, and the extent of the damage done, still unclear.
The state government said that it is notifying 1.3 million people including current and former residents, families of the dead and anyone else whose personal information may have been accessed in the attack.
It’s not clear if the attackers made-off with sensitive information, or if it had been used or sold on the black market. Richard Opper, director of the state’s Department of Public Health and Human Services, said that there’s “no indication” the hackers accessed the information or used it inappropriately.
If they did, hackers would’ve gained access to highly personal information such as Social Security numbers, medical records, medical insurance records, names, addresses and birth certificates. Not to mention the bank details of all health department employees.

4. Ebay

EBay went down in a blaze of embarrassment as it suffered this year’s biggest hack so far. In May, eBay revealed that hackers had managed to steal personal records of 233 million users. The hack took place between February and March, with usernames, passwords, phone numbers and physical addresses compromised.
Hackers successfully stole eBay credentials and managed to gain access to sensitive data. EBay encouraged users to change their passwords and reassured them that financial information was not stolen, as it’s stored separately and encrypted. Although there were further concerns that the stolen personal information could leave eBay users vulnerable to identity theft.
Despite eBay not confirming who was behind the attack, the notorious Syrian Electronic Army claimed responsibility. Despite the huge data breach and the sensitivity of the data, the SEA said that it was a “hacktivist operation” and that they “didn’t do it to hack people’s accounts”.
  1. Employee steals sensitive data on 350,000 Morgan Stanley clients
Speaking of insider threats, Morgan Stanley fired an employee who stole the account names, numbers and transaction data on 350,000 clients; the insider crook’s plan was allegedly to sellcustomers’ data.
The breach was discovered and reported to authorities on Dec. 27, after Morgan Stanley discovered sensitive data for over 900 clients on the Internet. Yet the bank claims that it has found no evidence that the data breach resulted in losses to customers. An unnamed source said “the information was displayed only for a brief period, though there were an unspecified number of hits on the site.” The New York Times added that the fired employee is believed to have taken “information on 10% of the 3.5 million customers of Morgan Stanley’s wealth management arm.
  1. Chick-fil-A credit card breach
In a data breach that likely does not affect the uber-rich like Morgan Stanley, Chick-fil-A — which operates restaurants in 1,850 locations over 41 states and D.C. — has confirmed an investigation into a credit card breach. In a public statement, Chick-fil-A said it discovered “unusual activity” on December 19th after being notified of “limited suspicious payment card activity appearing to originate from payment cards used at a few of our restaurants.”
The definition of limited, however, may not imply a small number after all. One unnamed financial institution said it received an alert that contained “nearly 9,000 customer cards” for a breach that potentially lasted between Dec. 2, 2013 and Sept. 30, 2014. Speaking on the condition of anonymity, a banking source told Krebs on Security: “It’s crazy because 9,000 customer cards is more than the total number of cards we had impacted in the Target breach.” The source added that “the bulk of the fraud seemed concentrated at locations in Georgia, Maryland, Pennsylvania, Texas and Virginia.”

Introduction

In today’s scenario the employers have understood their responsibilities and duties towards the health and safety of their employees and customer at their workplace. This has made them to create effective health and safety policies. This connects the employees with the employers with a sense of attachment and loyalty. In this assignment we will discuss about the health and safety policies, their implementation and effect on the employees about this healthy and safe working environment which results in the better working styles and outcomes for the organisation.

Task 1 A

At any workplace, the employer has a responsibility of taking health and social care of the employees along with the visitors at their premises like the suppliers and the customers. Therefore, in 1974 a Health and Safety act was implemented in United Kingdom which is a primary piece of legislation related to the work related health and safety of the employees. 1.1 Update of the heath and policy manual at the workplace

Here it is required to update the health and safety manual of our workplace. By keeping the legislation ion mind, the manual for the work place is constructed.
Employer’s Duties:
Under Section 8, the employer at the workplace has a certain duties towards the safety of health of the employee. The organisation will take care of:
  • Provision of the safe workplace with the usage of safe plant and equipment.
  • Provision of the proper training to the employees regarding the health and safety.
  • Prevention of any improper behaviour which can put the safety and welfare of the employees at risk.
  • Provision of proper and protective clothes and equipment at work.
  • Appointment of a competent person as a safety officer of the organisation.

Employee’s Duties:
There are certain duties which are set out under section 13 for employees and the organisation will take care of:

  • To take care of their health and care while working in the workplace.
  • Should not consume drugs or alcohol at the workplace.
  • They should not involve in the improper behaviour that can endanger others and themselves.
  • If they see any defect in the equipment they use, they need to directly report about it.
  • If the employer asked them to undergo under any medication or assessment, they need to understand that.
Risk assessment and safety statement:
Under the safety and welfare Act 2005, the employer of the organisation needs to carry out a risk assessment which will include all the hazards present in the workplace, identify the risk arising from those hazards and plan the steps to deal with those hazards. They need to make the statement as well that contains the details of the people responsible for the safety issues at the workplace. The employees should be given these statements and regular reviews should be done by the employer.
Protective equipment and measures:
The employer needs to tell the about all the risks that occur while wearing or working on the equipment in the workplace. The employer needs todeliver proper training to the employees before using any risky equipment and will provide all safety wears like clothing, headgear, footwear, gloves eyewear if necessary. In the same time the employee needs to take care of their own safety while using the risky equipment.
Reporting accidents:
All the accidents at the work place should be reported to the employer and the employer will take charge and responsibility that the accident is not repeated. If the employee is missing for three consecutive days, the employer should consider him as missing and report for him.
Health and safety leave:
Proper provision of maternity leave for the pregnant employees should be carried out in a separate risk assessment. If there are certain risks with the pregnancy, the employee should move out or removed. If both the cases are not possible, the employee should be given special leave till maternity.
Health and cleanliness:
Proper cleanliness, temperature, ventilation should be provided so that the employees are physically fit to perform at the work place.
Health and safety and young people:
The employees under 18 years should be considered in a different risk assessment and should be carried out before the employment of the young people and if the risk can arise due to the lack of experience, the young people should not be employed.
Bullying:
If there is any report regarding the bullying among the employees, the employer should establish proper procedures for dealing with such reports because ignoring such reports can damage the employee.
Harassment:
Considering the employment equity act 1998-2011, the employer should be obliged to play compensation if there is any incident of harassing the employee on the basis of civil status, gender, age, family status, community, religion or disability.
Violence at the workplace:
Proper safeguards should be applied in the workplace for elimination of any incident regarding violence at the workplace. The possibility of the violence should be considered in the risk assessment and handed over to the employees.
Victimisation:
The employee should not be victimised for utilising his own rights such as making complaints under safety and health legislation. (Citizens Information, n.d.)

1.2 The responsibilities for management of health and safety in relation to organisational structures

The management id completely responsible for the monitor and ensure that all the employees are trained for health and safety issues that can take place while working on the workplace this includes the proper cleanliness and placement of the risky equipment at their safe and designated place.

Safety Consultants:

2.1 Analyse the function of government, government sponsored bodies, and International agencies in travel and tourism
Government is the single governing authority in a country and they are further divided into smaller councils for each city or a region. Travel and tourism sector consists of a lot of natural sites which are considered as a national ownership of all. To govern this, it is necessary to have a system by which the resources will not be exploited for personal use by the managers, but it will be so developed into a system where everyone will be able to make use of it in a non-threatening way. Most governments usually has a ministry dedicated to  travel and tourism which looks after the development of the industry in the city or a region. The role of this government ministry is to promote the developed sites to other countries in the form of marketing campaigns, site specific marketing and promotions, participating in international exhibitions to showcase the city’s travel strengths and sites. The government can also sign bilateral trade contracts which enhances tourism between two countries by removing lot of trade barriers and tariff like service tax, value added tax, and transportation tax, etc. this could increase the number of arrivals as their spending per person will decrease and they will be able to spend more on leisure for themselves rather than paying for taxes.
Government sponsored bodies are also autonomous bodies which act on behalf of the government. These could include semi-government companies, specifically designed promotion organisations, etc. Their role is to promote the tourism products to different countries and explain the finer lines of the importance of certain sites and spots.
International agencies are bodies which promote multi-cultural tourism and encourage visiting to each other countries. These organisations usually promote countries with common interests, so that every participating country achieves their internal goals (Holloway et.al, 2009). Thus government, government sponsored bodies, and international agencies operate to promote their own tourism products, increase cultural mixing, and help each other to reach individual goals by serving common interests. Agencies like World Tourism Council, United Nations, International Air Transport Association, etc. all work towards supporting each other and enhancing the business of individual participant countries.
2.2 Explain how local and national economic policy influences the success of the travel and tourism sector
Local and national economic policy tend to have its effects on all sectors and not only the travel and tourism sector. Government’s job is to increase inward income by attracting investments by providing an environment conducive for investments and making the investors feel secure about their investments. The macroeconomic model of operations is very important to understand the presence and importance of the travel and tourism industry in the country’s policy context.

The above figure shows the flow of money from consumers to the firms to services and back to consumers. So to maintain this flow in an efficient way, government needs to design policies which enables consumers to spend in the market helping it to survive.
A policy change in the taxing structure of tourism industry like hotels can have either good or bad effects to the sector. If the economic policy increases the taxes from hotels, the sector may see a drop in occupancy and thus a subsequent drop in spending (Tribe, 2005). This can also make the hoteliers to consider some lay-offs generating unemployment. On the other hand, if the economicpolicy introduces a reform of providing tax exemptions to developers of small and budget hotels, the accommodation in budget hotels will go up and also the sector will experience ample addition of rooms by fresh investments. Similarly there are many other economic policy reforms like adding or abandoning value added tax in hotels, taxing higher to tour operators, making cheap finance available for hotel development or tourist site development, can have significant good or bad effects on the entire sector. Local and national policy may also vary sometimes, just like a local policy allowing restaurants to operate for prolonged time to increase revenues against the national policy of closing all restaurants at a fixed time thereby limiting their income. So local and national economicpolicies tend to have direct and indirect effect on the tourism sector.
2.3 Discuss the implications of political changes on the travel and tourism sector in different countries
Political scenario plays a significant role in steering the growth of the travel and tourism sector. When a country is experiencing elections, the focus is completely on the political parties and their manifesto for the tourism sector. The industry closely watches the political seen and gauges the expected turnaround in the policy reforms which will benefit the sector as a whole. Political leaders promote their individual ideas about each sector and of a leader wins and bringsin changes in the tourism sector by introducing a host of new reforms like complete abandoning of tax exemptions, regulatory changes in sourcing of raw materials from within the country even though importing it might cost low, etc. can actually make the tourism environment a little dull and new investments would not be encouraged. When political unrest increases in Thailand, the number of tourist arrivals from Europe, Japan, and other countries fell down, because tourist did not want to visit places where insecurity was high (Pinjiparakam, 2013). Similarly, when the political condition is smooth and calm, tourist tend to travel more often to such places, because they are assured of their own security and safety. When a good political party takes the governance in its hands, and focuses on building travel infrastructure, increasing airline routes, improving road safety, introducing variety of modes of travel like monorails, metro rail, freeways, etc. and develops tourists sites with the best facilities, the travel and tourism sector is for sure to receive more number of tourists and the entire city or a country improves its image in travel and tourism. This in turn encourages new tourists to consider visiting the country and thus a political change in the leadership with different views about the sector can have immensely positive effects on the sector as a whole.

INTRODUCTION

The following report will try to contrast over the topics involved with ‘Law of Tort’ and ‘Law of Contract’. This will be done by explaining the connotation of different important elements of contract in various cases. In support this report will explain the concepts of ‘Negligence’ and ‘Vicarious Liability’ by giving proper examples of the same.

“Explain the essential elements of a contract.”

Below are the important ‘elements of contract’:
‘Offer and acceptance’: In regard with the arrangement of contract it is necessary that there should be at least two parties involved. Among these two parties one party should make a proposal and another should accept the same resulting into contract.
‘Legal capacity’: For being a party to the contract it is necessary that the people involved should attain the age of majority and along with this they should be qualified by law i.e. they should not be declared insolvent or prisoner, etc.
‘Consideration’: An agreement cannot be treated as a contract if a valid consideration is not involved. With the term ‘valid consideration’ we mean that there should be some value for the consideration fixed in the agreement. It is not compulsory that the value should be only in terms of money rather it could be calculated in such forms also i.e. right, benefit, etc.
‘Legal relationship’: The proposed agreement should involve a kind of legal relationship among the parties to the agreement. This relationship should impose a kind of obligations among the parties in regard with the performance of contract (The Law Handbook, 2013).

“Should a contract have all those elements to be legally enforceable? What will happen if one of the elements was missing in an otherwise valid contract?”

Illegal or void contract:
Whenever the agreement deficit any of the elements given above then that agreement will be considered as a void contract, which means that they can be enforceable with the presence of that missing element. Whereas it is necessary that the agreement having the all above elements should not be contrary to law otherwise it will be treated as an illegal contract. Hence it is necessary that all the above mentioned elements should be there in order to form a valid contract.

“Is it possible to have a contract without face to face contact? Discuss.”

‘Distance Selling Contract’
“Online Shopping” is one of the examples of Distance Selling Contract. This type of contract particularly deals with the contract were the formation of contract is done without having face-to-face contact with the supplier. This could be done on telephone, emails or other modes of distance communications. For these types of contracts a special protection is governed by a particular regulation for the consumers. This is because here the consumers did not get the facility to meet with the supplier and even they could not inspect the goods or services beforehand.
“Consumer Protection (Distance Selling) Regulations 2000”
Following rights are concluded from this regulation for consumers:
  • Fortification from ‘card payment fraud’
  • Information regarding” supplier, goods or services and sale” initially before making any purchase.
  • A written confirmation should be there regarding the given information.
  • There should be a period of seven working days in which cancellations of the contract could be made (Out-Law.com, n.d.).

“Describe the effects of the words in the advertisement placed by the company informing the readers that it had placed £1000 with the Alliance Bank to meet any possible claim.”

Unilateral Contract:
In such kind of contract an express agreement is missing by the parties. Even then the law obligates the parties in a legal relationship once acceptance is made. Below given case is a very good example of this:
(Carlill v Carbolic Smoke Ball Co., 1893):
Here in this case there was an involvement of a unilateral contract. This formation is done with the help of an advertisement and the seriousness of this can be judged out by mentioning of reward deposition in bank. Further the below mentioned facts could be concluded from the contract:
  • The conclusion of serious nature can be done with the help of mentioned ‘words and actions’.
  • The offeror should be able to determine the acceptance made.
  • The judgement of a ‘unilateral contract’ could be easily make out from the given advertisement. Further the acceptance is concluded with the performance of the required conditions given in advertisement.
  • For the vague contract the description should be made in such a manner that intentional interpretation is possible easily.

TASK 2

“Give a clear opinion on whether the essential elements of a contract were present in the very first agreement between David and William. Identify the elements that were present and that were not.”

Following elements are involved in this situation:
  • Invitation to treat: David made an invitation to treat through an advertisement.
  • Offer: An offer was made by David by giving a quotation regarding the required work to be executed.
  • Acceptance: An acceptance is observed in this situation for the proposal, by William by agreeing all the terms and conditions and paying £1000 in advance.
  • Consideration: The sum of £18000 is considered to be a valid consideration for the performance of contract.
  • Legal Capacity: On 10.05.2014 both David and William are major and legally fit of entering into contract.
  • Legal Relationship: For the performance of the contract after accepting all the terms and conditions and nothing mentioned in the contract in support of making the parties free from any obligation creates a legal relationship between the involved parties.

“When William informed David of the requirement to complete the work before 31st July 2014, was a contract formed between them? Discuss.”

In the given situation the concept that “the silence cannot be treated as an acceptance” applies. This concept is derived from (Felthouse v Bindley, 1862). Here the offer made by William is not accepted by David by maintaining the silence regarding the offer for the completion of work till 31stJuly 2014. Further in the given situation a contract is observed when William accepted the proposal made by david with a consideration for the completion of work till the specified date which was not a part of initial contract between them.

“Discuss the position of David when he informed William on 25th June 2014 that he would not be able to complete the work before 31st July 2014. Was he in violation of the contract terms?”

As the time period was not a condition mentioned in the contract, no breach is observed while the refusal is made regarding the completion of work on 31st July 2014. Even the silence maintained by David is also not considered as an acceptance when William asked for the same afterwards. Hence as it was nowhere considered as a term of contract no liability lies on David.

“Explain the situation to David on his claim for the additional £2000 for completing his work before 31st July 2014”

In accordance to me, there is a formation of contract when the proposed offer was accepted by William in regard with the consideration of £2000 extra for the completion of work by 31st July 2014. The legal relationship evolving due to this contract creates an obligation for both the parties i.e. for William to complete the work till specified time and for David to give the specified consideration over the performance of contract.

TASK 3

“Describe, using example, how a liability in tort may arise. How does it differ from a contractual liability?”

‘Tortuous Liability’:
It is treated as a part of ‘private law’. The wrong committed by a person resulting into some injury to other, not only physical injury rather includes mental and proprietary injury also.
‘Contractual Liability’:

“Describe what have to be proved by the claimant in order for the courts to establish tort of negligence has occurred.”

“Describe the concept of ‘vicarious liability’. Give two examples where an owner of a business could be held liable for the actions of his/her employees. Also give two examples where an owner of a business would not be held liable for the actions of his/her employees.”

TASK 4

“Compare and contrast the verdict in Donoghue v Stevenson (1932) with Hill v Chief Constable of West Yorkshire (1989). What defences were used in each case? Give your view on the verdict of the second case. Do you consider it as a just verdict?”

PROBLEM
Samantha is a high school drama teacher responsible for organising the end-of-year school drama production. This year Samantha wishes to present her own comedy play – ‘Smurfs in Space’. Samantha is responsible for all aspects of the production including costuming, catering and set up. She has been encouraged to access volunteer resources where possible – including the school’s ‘Parents and Friends Association’. Samantha only has two weeks to get it all organised.
Samantha is aware of a 16 year old student – Julie – who has set up her own catering from home project
– preparing cakes and sandwiches for school events. Samantha speaks to Julie after class and asks whether she can prepare cakes and sandwiches for 100 people.
Julie says ‘Yes I can. I will need one weeks’ notice and the price/charge will be $5 per person, so $500 in total’. Samantha says ‘I will need to think about it for a day or two.’ Julie says ‘send me a Facebook message if you want me to proceed. I have a Facebook page – Awesome Cakes and Catering – where I take all our orders’. Later that week Samantha sends a text message to Julie’s phone, that says ‘go ahead with the cakes and sandwiches as we discussed’.
Julie uses ingredients out of her parents’ household fridge and cupboard to make the sandwiches and cakes. Julie’s mum Martha asks Julie to pay her back for the ingredients and Julie refuses. Martha contacts Samantha directly and says ‘Julie has used all my ingredients – you need to give me $100 out of the $500 Julie is to be paid to reimburse me’.
Samantha also needs costumes so she looks online and finds a website for ‘Outrageous Costumes’. She sends an email to Dave saying she needs three Smurf space suits, with extra silver and blue. Dave writes an email back saying that he can do this for her – he just needs to know the size of the costumes required. Dave also writes ‘Silver and Blue material is extra expensive. I rarely use it and will have to order it in specially’. Samantha immediately writes back and says ‘please go ahead and order the material – I will provide the measurements the week before the production’. Samantha also writes ‘we don’t have much time to get this all organised’. One week later Dave rings Samantha and leaves her a message, saying he has received the material, and unless he hears back from her, he will go ahead and start making the costumes. Samantha hears the message but ignores it, as a parent from the ‘Parents & Friends Association’ has offered to make the costumes for free. Two days before the school production, Samantha remembers she hasn’t spoken to Dave and rings him up to cancel the order. Dave is upset as he has nearly finished the costumes and will not be able to reuse them.
On the morning of the play Samantha realises she has no-one to assist with setting up. Samantha sends an email out to all parents saying ‘Attention all Parents – we need some volunteers to help set up for tonight’s play. The first 10 parents to arrive at 12.00 pm today to assist with the set up will receive two free tickets to tonight’s performance.’ Will is the older brother of a student who is performing in the play. Will sees the email and decides he wishes to watch the play. Will is amongst the first 10 people to arrive and assists with the setup of the play.
